Condition of Use — Name-Index Property Searches

Some property searches offered by Title Finder involve access to a Land Index name-search function operated by a state land registry (for example, LANDATA® in Victoria). Before we can deliver this type of search, you need to agree to the following Condition of Use.

What you can use this information for

You may use information obtained from a name-index search only for an Authorised Purpose, meaning:

  • a dealing with an interest in land authorised by law;
  • a purpose directly related to such a dealing (for example, preparing a vendor statement as required by law); or
  • a lawful enquiry relating to land or the ownership of land recorded in the relevant register.

An Authorised Purpose does not include data aggregation, data matching, data analysis or data mining, direct marketing, compilation, updating or verification of mailing lists, list brokering, or reverse engineering of the licensed material, except where required by law.

Confidentiality

You agree to treat information disclosed to you through this search as confidential, and not to disclose it other than for an Authorised Purpose. You will not copy or reproduce this information except for an Authorised Purpose, unless the relevant state authority has approved the copying in writing, or the person the information relates to has given written consent.

Breach

If you breach this Condition of Use, Title Finder or the relevant state authority may give you written notice, and your access to name-index search functions may be suspended or terminated if the breach is not remedied.

This page summarises, in plain language, the obligations that apply to name-index searches under the relevant state Conditions of Use (for example, Schedule 5 of the LANDATA® Conditions of Use in Victoria). It does not replace the full legal terms, which are available on request.
